Santa Delivers 37,000+ Copies of Constitution to Bush

December 20, 2007, Washington, DC – This morning, Santa Claus (in the person of noted constitutional lawyer Bill Goodman) drove his sleigh to the White House to deliver thousands of copies of the U.S. Constitution to President Bush.

Americans from all over the country – more than 37,000 of them – asked that a copy of the Constitution be delivered to the President in their name and cordially requested that he make time in his busy schedule to read it.  read more

Why Are So Many Americans in Prison?

A more convincing argument is that imprisonment rates have continued to rise while crime rates have fallen because we have become progressively more punitive: not because crime has continued to explode (it hasn’t), not because we made a smart policy choice, but because we have made a collective decision to increase the rate of punishment.

‘Fourth Branch’ Cheney strikes again

Cheney apparently STILL unsure his office is in the executive branch. Apparently he says it’s because he has legislative duties. Nevermind that the President has legislative duties too – the President signs the bills, so by Cheney’s logic the President can’t be considered to be in the executive branch either.  Click on the link below to be directed to MSNBC’s story on this matter.

Is Cheney too Powerful?

Dick CheneyThe President often dominates the political spotlight that most of the country tends to forget about the man next in line. With this in mind, ABC did an investigation of the Vice President’s office, in particular Cheney’s apparent ’quest’ for power.  Below is a short article regarding the power of Cheney, and at the bottom is a link to the original which contains a Good Morning America video segment featuring the Vice President. Please share your thoughts – is he too powerful?

ABC News examined the stunning extent of Vice President Dick Cheney’s grab for power over the last six years in a sometimes sardonic yet serious segment on Good Morning America Tuesday morning.

Reporter David Wright says Cheney is refusing to play by the rules that govern everyone else who works at the White House.

“So almighty and elusive is this vice president, the New Yorker once ran a cartoon in which theologians debated the existence of Cheney,” Wright said.

Noting a proposal in Congress to cut funding for the Vice President’s office, Wright said a Cheney spokeswoman called the proposal political, but she wouldn’t say “because the size of the vice president’s staff is apparently classified.”

Chief Washington Correspondent George Stephanopoulos examined the controversy surrounding Cheney and pronounced the current vice president the most powerful person to occupy the office in history. Stephanopoulos predicted the next president will pick as his running mate “the anti-Cheney.”

NBC News reported on Monday that “Dick Cheney is back in a very uncomfortable place for him: the headlines.”

“Has the vice-president gone too far?” asked NBC, adding that “the National Archives thinks so,” because Cheney alone in the executive branch has refused to file required reports or permit inspections of his office’s handling of classified material.

There’s Hope Afterall

”LOS ANGELES, California (AP) — Screaming and crying, Paris Hilton was escorted from a courtroom and ordered back to jail Friday after a judge, overruling the county sheriff, said she must serve out her entire 45-day sentence behind bars rather than in her Hollywood Hills home.”

Last Chance to Stop National ID

Have any of you heard about this? Apparently we (the United States) will be issuing a National ID card. Funny, I always thought that we were a FEDERAL government, and therefore such a policy would be seen as un-Constitutional. Nonetheless, I believe that we will hear more about this “ID” as we approach 2008. There will likely be a lot fo heated debate with this, especially since it is an unfunded federal mandate. Enjoy the article, it’s a bit dated but has some good information.

The U.S. House of Representatives passed a spending bill that contains provisions establishing a national ID card, and the Senate is poised to approve the measure in the next few days. This week marks the American public’s last chance to convince their senators they don’t want to live in a nation that demands papers from its citizens as they go about their lives.

Absent a political miracle in the Senate, within two years every American will need a conforming national ID card to participate in ordinary activities. This REAL ID Act establishes a massive, centrally coordinated database of highly personal information about American citizens: at a minimum their name, date of birth, place of residence, Social Security number, and physical characteristics. The legislation also grants open-ended authority to the Secretary of Homeland Security to require biometric information on IDs in the future. This means your harmless looking driver’s license could contain a retina scan, fingerprints, DNA information, or radio frequency technology.

Think this sounds farfetched? Read the REAL ID Act, HR 418, for yourself. Its text is available on the Library of Congress Web site. A careful reading also reveals that states will be required to participate in the “Driver’s License Agreement,” which was crafted by DMV lobbyists years ago. This agreement creates a massive database of sensitive information on American citizens that can be shared with Canada and Mexico!

Terrorism is the excuse given for virtually every new power grab by the federal government, and the national ID is no exception. But federal agencies have tried to create a national ID for years, long before the 9/11 attacks. In fact, a 1996 bill sought to do exactly what the REAL ID Act does: transform state drivers’ licenses into de facto national ID cards. At the time, Congress was flooded with calls by angry constituents, and the bill ultimately died.

Proponents of the REAL ID Act continue to make the preposterous claim that the bill does not establish a national ID card. This is dangerous and insulting nonsense. Let’s get the facts straight: The REAL ID Act transforms state motor vehicle departments into agents of the federal government. Nationalizing standards for drivers’ licenses and birth certificates in a federal bill creates a national ID system, pure and simple. Having the name of your particular state on the ID is meaningless window dressing.

Federally imposed standards for drivers’ licenses and birth certificates make a mockery of federalism and the 10th amendment. While states technically are not forced to accept the federal standards, any refusal to comply would mean their residents could not get a job, receive Social Security, or travel by plane. So rather than imposing a direct mandate on the states, the federal government is blackmailing them into complying with federal dictates.

One overriding point has been forgotten: Criminals don’t obey laws! As with gun control, national ID cards will only affect law-abiding citizens. Do we really believe a terrorist bent on murder is going to dutifully obtain a federal ID card? Do we believe that people who openly flout our immigration laws will nonetheless respect our ID requirements? Any ID card can be forged; any federal agency or state DMV is susceptible to corruption. Criminals can and will obtain national ID cards, or operate without them. National ID cards will be used to track the law-abiding masses, not criminals.

Paris Hilton: “I didn’t mean to do it!”

Do people honestly believe because they are rich that the law doesn’t apply to them?  This article cracked me up.  Paris’ statements are like that of a 7yr old (i.e. “I didn’t mean to do it”).  HAHA, what did she expect the Judge to do?  Say that it’s okay she was driving on a suspended license, drunk? Anyway, enjoy the article, I know I did.

———————–
LOS ANGELES – A judge sentenced Paris Hilton to 45 days in county jail Friday for violating her probation, putting the brakes on the hotel heiress’ famous high life.

Hilton, who parlayed her name and relentless partying into worldwide notoriety, must go to jail on June 5 and she will not be allowed any work release, furloughs, use of an alternative jail or electronic monitoring in lieu of jail, Superior Court Judge Michael T. Sauer ruled after a hearing.

The judge ruled that she was in violation of the terms of her probation in an alcohol-related reckless driving case.

“I’m very sorry and from now on I’m going to pay complete attention to everything. I’m sorry and I did not do it on purpose at all,” she told the judge before he announced the sentence.

She was then ordered to report to a women’s jail in suburban Lynwood on the set date or face 90 days behind bars. The judge’s ruling excluded her from paying to serve time in a jail of her choice, as some are allowed.

As a city prosecutor said during closing arguments that Hilton deserved jail time, Hilton’s mother, Kathy, laughed. When the judge ruled, Kathy Hilton, then blurted out: “May I have your autograph?” Paris Hilton was among a series of witnesses who took the stand during the hearing. She testified she believed her license was initially suspended for 30 days and that she was allowed to drive for work purposes during the next 90 days.

She said that when an officer who stopped her in January made her sign a document stating her license was suspended, she thought he was mistaken and did not actually look at the document.

Also called to the stand was Hilton’s spokesman, Elliot Mintz. Hilton and her attorneys characterized Mintz as a liaison between Hilton and her lawyers. Mintz testified that to his knowledge Hilton did not drive during the 30-day period. He said he then advised her that he believed her license was no longer suspended.

The judge called Mintz’s testimony worthless and expressed disbelief at Hilton’s lawyers.

“I can’t believe that either attorney did not tell her that the suspension had been upheld,” the judge said. “She wanted to disregard everything that was said and continue to drive no matter what.”

Appeal in the works

Hilton looked forward and didn’t speak to news media as she left court. Her mother looked upset.

When a reporter asked what she thought of the judge’s decision, a visibly angry Kathy Hilton responded: “What do you think? This is pathetic and disgusting, a waste of taxpayer money with all this nonsense. This is a joke.”

One of her attorneys, Howard Weitzman, said he would appeal.

“I’m shocked, I’m surprised and really disheartened in the system that I’ve worked in for close to 40 years,” Weitzman said.

He said the sentence was “uncalled for, inappropriate and bordered on the ludicrous.”

“I think she’s singled out because of who she is,” Weitzman said.

Hilton had arrived at the Metropolitan Courthouse 10 minutes late and ignored screams of photographers as she swept in with her attorneys, mother and father, Rick Hilton. Wearing a gray jacket and white shirt over black slacks and with a black headband on, she said nothing and appeared serious.

The celebrity case brought an unusual scene to the austere courthouse south of downtown in a commercial area. As if at a red carpet event, dozens of photographers and reporters lined up at the rear entrance. Yellow police tape substituted for velvet ropes.

Hilton, 26, pleaded no contest in January to reckless driving stemming from a Sept. 7 arrest in Hollywood. Police said she appeared intoxicated and failed a field sobriety test. She had a blood-alcohol level of .08 percent, the level at which an adult driver is in violation of the law.

She was sentenced to 36 months probation, alcohol education and $1,500 in fines.

Two other traffic stops and failure to enroll in a mandated alcohol education program, are what landed the socialite back in court.

On Jan. 15, Hilton was pulled over by California Highway Patrol. Officers informed her that she was driving on a suspended license and she signed a document acknowledging that she was not to drive, according to papers filed in Superior Court.

Los Angeles County sheriff’s deputies stopped Hilton on Feb. 27 and charged her with violating her probation. Police said she was pulled over at about 11 p.m. after authorities saw the car speeding with its headlights off.Mintz said at the time Hilton wasn’t aware her license was suspended. A copy of the document Hilton signed on Jan. 15 was found in the car’s glove compartment, court papers say.

Hilton was also required to enroll in an alcohol education program by Feb. 12. As of April 17, she had not enrolled, prosecutors said.

Hilton, heiress to the Hilton Hotel fortune, first gained notoriety for her hard partying as a teen. She attracted worldwide attention when a sex tape she made with a boyfriend was released on the Internet.
